Kentucky drivers know the dangers of driving under the influence, but that does not keep some people from getting behind the wheel anyway. Other drivers do what they can to keep an eye out for impaired drivers in an attempt to keep themselves safe. Sadly, those efforts are not always enough to avoid a devastating car accident that could result in severe or fatal injuries.
There is no guarantee that a motorcycle rider and passenger involved in a recent crash could have anticipated the actions of another driver with whom they were sharing the road. As the 44-year-old man and a 34-year-old woman rode through an intersection, the driver of a minivan failed to stop at the red light. The minivan came into the motorcycle’s path, causing a collision.
The driver and passenger on the motorcycle suffered such severe injuries that they needed to be taken from the scene by helicopter once emergency medical personnel provided care at the crash site. Their injuries are considered life-threatening. Meanwhile, the 47-year-old woman driving the minivan was suspected of drunk driving and taken into custody at the scene. She faces two charges of first-degree assault and one charge of DUI.
As the two on the motorcycle recover from their injuries, they will undoubtedly incur significant medical expenses, lost income and other damages. They may exercise their individual rights to file personal injury claims against the woman believed to have caused this devastating car accident. Successfully establishing her negligence to the court could result in an award of damages from a Kentucky civil court.
