Regardless of how quickly police respond to calls regarding motor vehicle crashes, they do not always get there in time to save the lives of those involved. In addition, the scene of a devastating car accident can sometimes be so chaotic that identifying who the driver was can be a challenge. This appears to be the case in a recent crash that took place here in Louisville on Herr Lane.
Officers with the Louisville Metro Police Department responded to the scene after receiving calls of a vehicle traveling at a high rate of speed at approximately 3:30 a.m. on a recent Sunday morning. By the time officers spotted the erratically moving vehicle, it had reportedly crashed and burst into flames. The condition of the scene did not even reveal the number of people in the vehicle — let alone who was driving or what caused the crash.
It was not until around 8 p.m. that same day when police were able to confirm that two people in their mid to late teens occupied the vehicle — a woman and a man. At last report, investigators had yet to determine which of them was driving at the time of the crash, or if there were any outside factors that could have caused it. This piece of information could prove crucial to the families of the deceased.
The family of the passenger in this devastating car accident may exercise their right to file a wrongful death claim against the estate of the driver, along with anyone else who may bear some legal responsibility for the crash. Successfully proving to the court that the death of their loved one resulted from the negligence of the driver could result in an award of damages, if that is indeed the case. If the driver was not at fault, the family may still have a case, depending on the circumstances. Any restitution received may help with the financial losses that ordinarily accompany such tragedies.
